Employee Classification and Overtime Pay and Allowances

Employees are classified as management or staff based on applicable laws and the Collective Bargaining Agreement, CBA. If you have questions about your status, refer to your job description and ask your manager for clarification.

Staff (hourly): All employees are eligible for overtime pay. The standard work day is 8 hours in a 24 hour period or 40 hours in a calculated workweek. Employees will be paid “straight time” or their regular hourly rate for all regular hours worked in the workweek up to 40 hours.

Overtime:

Situations may arise that require overtime. AUA will attempt, whenever practical, to notify employees of overtime needs in advance and to meet those needs through qualified volunteers.  Nonetheless, reasonable overtime is a shared responsibility of all employees.  All overtime must be authorized in advance by the employee’s manager. Overtime is calculated in accordance with the AT&LU collective agreements of the Line Staff and Security department.

 Overtime Pay Requirements:

  1. Prior written approval from your manager to work overtime including the number of hours to be worked; the agreed upon day and time of when the work is to be performed; and the business reason for the overtime work.
  2. Overtime worked must be indicated on each employee’s time record during the workweek in which the time was worked.
  3. Paid leave and approved leave of absences either paid or unpaid are not included in hours worked for the purpose of overtime calculation.
  4. Compensatory time off in a different workweek to make up for unpaid overtime is in violation of applicable laws and not permitted under any circumstances.

 Allowances:

In agreement with the collective bargaining agreements of the Line Staff & Security.

 Exempt Employees: Management and confidential employees are not eligible for overtime pay or allowances in accordance with the collective agreement. Management employees include supervisors, managers and executives. Confidential employees include any employee who has access to confidential or discretionary information including legal advise, labour/employee relations and budget formulation and implementation. Exempt employees may be eligible for time in-lieu when they engage in extensive travel, weekend work or extended hours to accomplish the demands of their role.

Time In-lieu Requirements:

  1. Prior written approval from your manager/executive as to when time in-lieu may be or has been earned.
  2. Time in-lieu earned and worked must be indicated on the time record for the appropriate pay period.
  3. Time in-lieu must be taken within 30-days of when it is earned and has no cash value.
